WHAT IF YOU ARE UNABLE TO MANAGE YOUR OWN AFFAIRS

 You may very well have made a Will and assumed that your affairs were “in order”, but who will help you in later life if you become unable to look after yourself, or even in the near future if an accident means you can’t lead a normal life? “Oh my family will look after me.”  Well, yes they’d like to. But tell that to your Bank Manager when you need to withdraw some cash, or to your broker if you need insurance, or to your GP when he needs consent for a medical procedure. It may seem like “red tape” or bureaucracy but your family will be told they can’t help, or get help for you, unless they have your written authority.

That requires a Power of Attorney. Without one, you could leave your family in a dreadful position. They want to help you but they are not allowed to. The only solution by then is to go to Court and experience the difficulties, delay and expense of obtaining a Court Order to look after your affairs – a Guardianship Order. That really has to be a desperate last resort.

WHAT IS A POWER OF ATTORNEY?

A power of attorney is an authority given by an individual (known as the Granter) to another person(s) (known as the Attorney) to deal with aspects of the Granter's affairs. This could relate to financial/property matters and/ or personal welfare.
Powers relating to the Granter's financial /property affairs are known as "continuing powers" and may be given with the intention of taking effect immediately and continuing upon the Granter's incapacity or beginning on the incapacity of the Granter. Welfare powers cannot be exercised until such time as the Granter has lost the capacity to make these decisions.
